Your use of this website signifies that you accept and agree to be bound by these terms and conditions and consent to us using your information in accordance with our privacy policy. If you do not accept these terms and conditions of use, do not use this website.  [You must be 18 years of age or older to purchase goods from the website.  If you are under 18, you may use the website only with the oversight of a parent or guardian.]

The content of any such websites is not under our control; accordingly we do not accept any responsibility or liability for the content of these websites. Any links to external websites do not signify endorsement of these websites in any way whatsoever.

Metal (or other) allergic reaction, known or unknown, arising during the wearing of jewellery or clothing.

Inappropriate use, treatment or storage of emmahutton.com items after delivery, or the use of jewellery items or clothing by children.


These terms and conditions do not affect your statutory rights (if appropriate) as a consumer.  We do not exclude or limit our liability in respect of death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.  [In so far as is permissible by law, Emma Hutton’s liability to you in connection with any claim or series of connected claims under these terms and conditions shall not exceed the value of the goods and delivery costs to which the claim is relevant.]


Privacy Policy


In accordance with The Data Protection Act 1998, we fully respect customer privacy and do not sell or divulge any personal information supplied by you to any third parties.  [Any personal data gathered by us in your use of this website will be recorded and only used in accordance with the UK Data Protection Act 1998.]


Your personal details are treated as strictly confidential including name, email address, address, telephone number and any other information collected by us. We do not see or collect any of your credit card details online; all your credit card details are processed through the secure gateway Paypal.

Contact details you give us may be used by us to keep you informed of products and services, including special offers, discounts, and competitions by email or post. If you do not wish to receive any marketing material from emmahutton.com please email us to let us know.

We take all reasonable steps to protect your personal information. You accept the inherent security risks of providing information and dealing on-line over the internet and will not hold us responsible for any breach of security unless this is due to our negligence.

If you are concerned about sending personal information via the internet, we would advise you to provide us with your details via telephone and pay by cheque.

Contract for sale or services


No contract of sale is formed between you and Emma Hutton until you receive the ‘confirmation of order’ email/notification from Paypal.


Orders shall be accepted at our sole discretion [and will depend on stock levels amongst other factors].  Once you have selected the items you require and added them to your basket you will be forwarded to the Paypal checkout page, where you will have an opportunity to amend or confirm your order prior to your payment details being processed. Please keep your ‘confirmation of order’ email for your records.  In exceptional circumstances, if we are not able to fulfil an order we have accepted, your credit card will be re-credited with the original price and we will notify you by email.  In no circumstances will we be liable to you for any additional amounts.


These terms and conditions cannot be varied except by changes made by us on this website, which we may make from time to time.  The terms and conditions applicable to your purchase will be those on the website at the time you made the purchase and will be sent with your order.


You will only own the goods you purchase once they have been successfully delivered and when we have received full payment for them.  Until that time, we will retain title to the goods.  Goods supplied are not for resale.


Materials

“Vintage” and “Antique” means that the item has not recently been made and also means it has been used in the past. Antique and vintage jewellery used in our products have been chosen for their aesthetic value and character, and their condition will not be perfect. Minor surface scratches and dents are well in keeping with age and use. Vintage and Antique jewellery has more character if left untouched, however, it is up to the buyer's discretion whether or not to preserve the beautiful patina created by age.

Sterling silver is used without exception in jewellery construction. Where vintage and antique pieces are used, while we endeavour to choose pieces of the highest quality they are principally selected for their aesthetic values and therefore on occasion may be made from plated or base metal.

As each item of jewellery is handmade there may be slight variations in design or materials used.

All necklaces and bracelets have a hallmark, which is your guarantee of sterling silver or gold as applicable. Please note, silver can eventually tarnish or wear with time and excessive use.
We strongly advise that tiaras are stored within the original packaging or other safe box until the wedding date, and that you avoid direct application of hairspray/styling products or perfume to them.




Production Times and Delivery


For bespoke / commissioned tiaras, please allow up to eight weeks between placing your order and receiving your tiara. It is strongly advised that you place your order well in advance of your wedding date.  

All other jewellery items are individually hand crafted to order. I always aim to deliver your order as early as possible but please allow up to 28 days between placing your order and receiving jewellery items (not including tiaras).  The placing of an order by you signifies that you agree to these production times.


If you need your tiara or jewellery sooner than the stated times, please contact me first to check that your order can be completed within the timescales required. We will always try to meet your requirements.


A reputable courier service is used for all tiara deliveries. This may be the customer’s choice of courier, where a preference is expressed. Delivery charges will be advised at the time of placing an order and these charges will be itemized on the invoice.
Owing to the need for a signature upon receipt, we cannot be held responsible for failure of a recipient to sign for a package.  

All other jewellery (not including tiaras) supplied by us, will be sent via Royal Mail Special Delivery.

You are responsible for making arrangements to receive the goods and if the goods are held at a post office or other delivery company’s depot because no-one was available when the goods were delivered then it is your responsibility to swiftly collect the goods.


Where we indicate delivery times and dates, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control.



Payment

We accept payments made by PayPal and also by UK cheque/postal order.

A 30% non-refundable deposit is required before beginning work on a tiara or any other bespoke / commissioned item.
Payment must be received in full before goods are dispatched.
Please allow 3 to 5 working days clearance time for cheques. Goods remain the property of Emma Hutton until full payment is received.


Order Cancellation, Returns & Refunds

For tiaras:

An order can be cancelled before the deposit is paid. No consultation fee will be levied and there is no obligation to proceed with any of the suggested designs.
An order can also be cancelled before final payment is made, noting that the 30% deposit will not be refunded. Once the outstanding balance is paid, the goods will be dispatched and are then non-refundable and non-returnable (except in the case of damaged goods and only then where the notification procedure - outlined below - is adhered to).
This policy is operated in compliance with Regulation 13(c) of The Consumer Protection (Distance Selling) Regulations 2000.


Where the tiara is found to have been damaged during the delivery process, please notify us within 24 hours of receipt. Goods returned via post without prior notification will not be accepted.

Following assessment of the damage, we shall repair or remake the item.
Only in the specific situation whereby it will not be possible to mend a tiara in the time remaining before the wedding date shall a refund be issued (inclusive of the 30% deposit and delivery costs – note that this is the only circumstance in which a refund will be given).
We will require proof of your wedding date before a refund can be processed. Whilst this is an undesirable outcome and very unfortunate, we shall not be held liable for negligent delivery methods on the part of the courier resulting in such a situation.

For all other jewellery items:

If, when you receive your order, you are not satisfied you have up to 7 working days, starting on the day after receipt, to cancel your order and you must then return the ordered products to us as soon as reasonably possible. The goods must be unused, in the same condition as they were originally dispatched from us, and with the original packaging. Items must be returned via the same delivery method by which they were despatched to you.  You must take reasonable care to ensure that we receive the goods and that the goods are not damaged in transit.  You have a legal obligation to take reasonable care of the goods while they are in your possession.  This includes not trying on earrings or removing their hygiene seals.


Postage costs will not be eligible for refund, unless the item is faulty or was despatched in error.


If you realise you have made a mistake and want to cancel an order, please contact us as soon as possible.  If it is not possible to stop your order before despatch, please follow the usual returns process as set out above.


If goods are lost in transit from us to you and this is confirmed to us by Royal Mail or the courier service used, we will either send new goods or offer you a full refund, including delivery charges.


If you should receive an item which is defective, damaged or not what you ordered, please contact us as soon as possible via phone or email.  We will seek to resolve the issue as soon as reasonably possible by delivering another item, replacing your order or refunding the amount paid.


Where refunds are given, this will be done via the original payment method.


Governing law

These terms and conditions, this website and any contracts between you and Emma Hutton shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be dealt with under the exclusive jurisdiction of the courts of England and Wales.  If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity or enforceability of any remaining provisions.  If we fail to enforce a right under these terms and conditions, that failure will not constitute a waiver by us and will not prevent us from enforcing other rights or the same type of right on a later occasion.


No part of these terms and conditions are enforceable by anyone who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.


Your statutory rights are not affected.
